Refund Policy

The general terms and conditions of sale of VORWERK BENELUX (“GTC”) apply to the sale of VORWERK BENELUX products (the “Product”) to customers via its website (“Webshop”). The GTC take precedence over all other general terms and conditions of sale. Any amendment to the GTC comes into effect as soon as it is posted online and does not apply to previous transactions.

Orders are placed online via the Webshop, using a form, and are subject to stock availability. If the Product is unavailable after the order has been placed, VORWERK BENELUX must notify the customer of this within a reasonable period of time. The customer may obtain further information about the Products from VORWERK BENELUX’s customer service department.

The sale is only concluded upon express acceptance by VORWERK BENELUX. However, VORWERK BENELUX reserves the right not to fulfil or to cancel orders, with a refund of any advance payment made, if the orders appear dubious, such as, but not limited to, orders placed by minors, insolvent customers, customers with no known address or customers who provide false information.

VORWERK BENELUX reserves the right to suspend or refuse any order from a customer who has not paid for a previous order or with whom a dispute has arisen. Placing an order implies that the customer has fully accepted the T&Cs.

The Product will be invoiced at the price applicable at the time the order is placed. Prices are quoted in euros, inclusive of all taxes. Delivery costs are payable by the customer and are stated separately.

In the event of late payment and without any prior notice of default, (i) interest on arrears at the statutory rate shall be payable by operation of law and (ii) the outstanding balance shall be increased by operation of law by a fixed compensation of 10% of the amount due, with a minimum of 125 euros. The parties agree that this is a reasonable estimate of the fixed compensation, which may be increased or reduced if the party concerned provides evidence to that effect. In the event of legal recovery, all recovery costs shall be borne by the customer. An incomplete delivery of an order does not justify a delay in payment for the goods delivered. VORWERK BENELUX may issue partial invoices to the extent that the goods have been delivered. Payment of the invoices cannot be made conditional upon the installation and commissioning of the equipment.

Delivery times are not binding and are purely indicative, unless expressly stated otherwise. The risks pass to the customer when the customer or a third party designated by the customer takes physical possession of the Product.

The Products sold remain the property of VORWERK BENELUX until full payment of the price and any other amounts owed by the customer. The customer is liable for any damage to or depreciation in value of the Product compared to its new condition resulting from use, damage to the packaging, etc. In the event of seizure, forfeiture or other measures taken by third parties in relation to the Product, for whatever reason, the customer shall fully indemnify VORWERK BENELUX against all claims and costs arising therefrom. In this case, the customer must inform the third party that the Product is the property of VORWERK BENELUX. If the price has not been paid in full within the agreed period, VORWERK BENELUX may, at its discretion, demand the return of the Product by, where applicable, refunding the amounts already paid by the customer or by blocking the device’s functions.

Complaints regarding the Product must be submitted in writing and the existence of a defect must be demonstrated. VORWERK BENELUX shall not be liable if the defect did not exist at the time of delivery of the Product or if the customer was aware of the existence of the defect at the time of purchase. Complaints must be submitted within 14 days of receipt of the Product. After this period, complaints are invalid and have no legal consequences.

The Product is covered by a parts and labour warranty, including Vorwerk Comfort Service, in accordance with the terms and conditions of VORWERK BENELUX from the date of delivery. The Product is covered by a two (2)-year warranty. This warranty does not apply:

• in the event of misuse, normal wear and tear, improper maintenance or a lack of maintenance and/or hygiene;

• in the event of the use of accessories or equipment other than those supplied by VORWERK BENELUX or of spare parts other than original VORWERK parts;

• in the event of intervention or modification of the appliance by an unauthorised third party or the customer;

• in the event of failure to comply with the user manual;

• in the event of connection to a non-compliant electrical installation;

• in the event of force majeure such as a natural disaster, lightning, flooding, fire, or an accidental event or an external cause;

• in the event of a faulty Wi-Fi or Bluetooth connection or the absence of a Wi-Fi or Bluetooth connection, for whatever reason.

The above provision does not affect the provisions relating to hidden defects and (non-)conforming delivery.

In the event of non-compliance with the safety rules as set out in the Product’s user manual, VORWERK BENELUX shall not be liable for any damage caused to the customer or third parties, whether to animals or property. Any accident must be reported immediately to VORWERK BENELUX, which may request the appliance for examination. Under no circumstances may the condition of the appliance be altered following the accident.

The customer has a right of withdrawal for 14 days from receipt of the Product, including where the Product is received via a third party. To exercise this right, the customer may use and complete the withdrawal form provided or submit a statement specifying the order number and their decision to return the order. The Product must be returned in its original packaging to the address provided by

VORWERK BENELUX:

Mechelsesteenweg 586C
1800 Vilvoorde – BELGIUM

During the withdrawal period, the customer must handle the Product and the packaging with care. This means that the customer may only unpack the goods to determine whether or not they wish to keep the Product. In the event of withdrawal, the customer is responsible for the costs of returning the Product and any loss of value or damage to the Product caused by handling the Product beyond what was necessary to establish its nature, characteristics and functioning, as well as the costs associated with new packaging. In the event of damage to the Product or the packaging, VORWERK BENELUX will charge any repair costs and/or the total value of the damaged Product or packaging.

The customer’s personal data is collected and processed by VORWERK BENELUX, which acts as the data controller.
VORWERK BENELUX refers to its privacy statement, which can be consulted on its website via this link Privacy Policy and which also sets out the data processed, the grounds and purposes of the processing, and the rights and obligations relating to the processing of personal data. By placing an order, the customer confirms that they have read and accept the privacy statement.

If any provision of the order and/or the GTC is or becomes wholly or partially void, this shall not affect the validity of the other provisions. The parties shall, in good faith, replace the invalid provisions with an equivalent provision that best corresponds to the intention of the order and/or the GTC. In the event of total or partial invalidity, the court may always moderate the invalidity and limit it to the unreasonable part.

Belgian law applies to the order, the sale, its performance, etc., and the General Terms and Conditions. All disputes relating to or arising from the order and/or the General Terms and Conditions fall within the exclusive jurisdiction of the courts of Brussels.
